13 issues in zoning
Joint Jurisdiction Zoning Area boundary reduction
The city and county were poised to finally adopt a smaller joint zoning boundary first proposed in the April 2026 Comprehensive Plan. Since 2012 the city has annexed about 324 acres (plus the 232-acre airport annexation), but the boundary never shrank to match — this would fix that. A similar combined amendment failed in July 2026 before the two bodies split it into separate ordinances.
Proposed data center zoning ordinances (1565-1570)
A six-ordinance package defines data centers by megawatt size and sets where they can go — conditional uses in General Business and Light Industrial, and in General Industrial and Heavy Industrial districts including Hyperscale facilities. New rules cover noise (with certified engineers and baseline reports), cooling liquid restrictions, screening, and peak electric demand reporting. The commission split on allowing Hyperscale data centers, the largest class.
Rezoning at 112 East Cherry Street
The city is considering rezoning land at 112 East Cherry Street — plus adjacent vacated street and alley strips — from general business to residential (R-3). The public hearing is where neighbors get to speak before the council takes any action.
Rezone near Dakota Dome to R-3 residential
The property owner wants to build apartments on lots currently zoned single-family residential, next to land owned by USD (which is exempt from city zoning). The rezone is the key that unlocks apartment construction there.
Sign code review — off-premise and banner signs
Businesses in commercial and industrial zones along the bypass can now build freestanding signs up to 300 square feet, with buffers from residential areas.
Bluestem Trail Addition rezoning
Land on the east side of North Crawford Road is now R-3, opening the door for townhouses and a cohousing community. Ordinance passed its second reading unanimously.
Munger Ridge Planned Development District
A new zoning district would allow a rural-style subdivision on recently annexed land south of the Vermillion River — one-acre planned lots, septic systems initially, ditches instead of curbs, and sidewalks deferred. Water service comes from the city; future sewer plans are already being laid out.
Apartments above gas stations — new zoning use
Two ordinances would let residential units sit above convenience stores tied to gas stations in the General Business district — sparked by a citizen who bought the old Stewart Oil building on East Cherry Street. No other state has quite this use; the council advanced both on first reading with 45- and 60-foot separation rules.
Ward boundaries updated after annexations
Ordinance 1558 finally put the newly annexed Munger and Bluestem tracts into the Northwest and Southeast Wards. Both are vacant land, so nobody's representation changes today.
New ward boundaries for annexed land
The Munger Tracts will join the Northwest Ward and the Bluestem Tract the Southeast Ward. Both areas are vacant now, so no voters change wards yet — a fuller rebalancing waits for the 2030 census.
2025 Joint Jurisdiction Comprehensive Plan
Vermillion and Clay County are rewriting the shared zoning blueprint that covers land around the city. The sticking points: the plan shrinks the joint zone by about 1,391 acres, and a new annexation section implies the county gets an equal say in city annexations — which isn't how state law works. No decision yet; talks continue April 6.
Side-yard setback variance at 610 Catalina Avenue
A homeowner wanted to double his garage, needing one foot less setback than code allows. The council granted it over a neighbor's objections about fire risk, privacy, and precedent.
Staggering planning and zoning commission terms
Right now a new council can inherit four or five empty planning commission seats at once. Ordinance 1552 would spread appointments out to about three per year — it advanced on first reading.
